The property was sold in 1960.And the contract had an "exempt"from sale of the Cemetery. that owner died and the present owner is attempting ownership of the Cemetery.
He needs the acreage of the Cemetery to get the adjoining
Lots zoned for housing.Who owns the Cem. the heirs or him?
We argue the heirs own the Cem. by it being exempt from the
sale in 1960. We have a survey made 1n 1939 by the State
Highway Dept. of the Cem. before is was cleaned off in 1962
for pasture.
